In relation to #PSAdvisory 2025-006 dated June 26, 2025, announcing the unavailability of Microsoft Software and Licenses in the Procurement Service - Department of Budget and Management (PS-DBM) beginning June 30, 2025, this notice is being issued to remind client-agencies that the selection of the appropriate mode of procurement from other sources shall be based on the technical and legal requirements of the procurement project. This means that no specific mode of procurement, such as Direct Contracting, is automatically allowed.
In line with the provisions of the New Government Procurement Act (NGPA) and its IRR, procuring entities must also be able to justify the use of the selected procurement mode, conduct market scoping activities, and ensure proper documentation for audit.
